ZANTAC® Chili Challenge Contest 2010

THE ZANTAC® CHILI CHALLENGE 2010 CONTEST (THE “CONTEST”) IS INTENDED TO BE CONDUCTED IN CANADA ONLY (EXCLUDING THE PROVINCE OF QUEBEC) AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY IN THEIR PROVINCE OR TERRITORY OF RESIDENCE OR OLDER AT THE TIME OF ENTRY. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

  1. ELIGIBILITY. To be eligible for this Contest, an individual must:
    1. be a legal resident of Canada (excluding the province of Quebec);
    2. be of the age of majority in his/her province or territory of residence or older at the time of entry;
    3. be the sole owner of all right, title and interest (including copyright) in and to the Work (as defined below) submitted in connection with the Contest; and
    4. be legally able to travel to within Canada to any city including but not limited to Vancouver, Ottawa, Halifax and Toronto and be able to travel internationally to Mexico and have any and all necessary documentation as may be required for presentation to Canadian and/or international customs and airport personnel.

    Employees of McNeil Consumer Healthcare, division of Johnson & Johnson Inc. and (the "Sponsor"), their respective affiliates, subsidiaries, related companies, advertising and promotional agencies including but not limited Edelman Communications Inc. ("Agency"), judges of the Contest and the household members of any of the above, are not eligible to participate in the Contest.

    The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

  2. CONTEST PERIOD.
  3. The Contest begins at 12:01 a.m. Eastern Standard Time (“EST”) on November 15, 2010 and ends at 11:59 p.m. EST on December 29, 2010 (the "Contest Period") after which time the Contest will be closed. The online recipe submission period (“Submission Period”) begins on at 12:01 a.m. on November 15, 2010 and closes at 11:59 p.m. on December 13, 2010 after which time no further entries shall be accepted.  The voting period shall begin at 12:01 a.m. on December 14, 2010 and ends at 11:59 p.m. EST on December 29, 2010 (“Voting Period”) after which time the Voting Period will be closed and no further votes may be cast.

  4. HOW TO ENTER.
    1. There is no purchase necessary to enter the Contest. Enter using the method of entry outlined below. No entries will be accepted by any other means.
      1. To enter online, complete and submit the entry form located at www.chilichallenge.ca (the “Contest Website”) during the Entry Period, complete the online recipe entry form, provide your original chili recipe (and an optional photo of the recipe) (collectively, the “Recipe”) and submit as instructed. All fields on the Recipe entry form must be completed unless they are indicated as optional. Recipe photos should not include any individuals; if Recipe photo contains the likeness of an individual, entrant warrants that he/she has obtained such individual’s consent in writing (or in the case of a minor individual, the consent of such minor’s parent or legal guardian).
    2. Each entrant must submit an entry form together with their Recipe (hereinafter the "Work").
    3. By participating in this Contest, entrant represents and warrants that: (i) the Work does not contain any material that is libelous, defamatory, profane or obscene in accordance with these rules; (ii) the Work is original and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the entrant to the full extent necessary to enable the Sponsor to use the Work as contemplated by these Contest Rules; and (iii) the Work does not infringe upon the intellectual property, privacy or other statutory or common law rights of any third party.
    4. Limit of one (1) entry per person during the Contest Period. In the case of multiple entries, only the first eligible entry will be considered.
    5. All entries including the Work, become the sole property of the Sponsor and none will be returned for any reason. Entries must be received no later than the end of the Contest Submission Period. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with those selected for a Semi-Finalist Prize, Finalist Prize, or Grand Prize.
    6. Entries received online shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the entry. For the purpose of the Contest Rules, "authorized account holder" of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each selected entrant may be required to provide the Sponsor with proof that the selected entrant is the authorized account holder of the e-mail address associated with the winning entry.
  5. PRIZES.
    1. Semi-Finalists Prizes. There are nine (9) semi-finalist prizes ("Semi-Finalist Prizes", and each, a "Semi-Finalist Prize") available to be won by the Contest semi-finalists ("Semi-Finalists", and each, a "Semi-Finalist"), each of which consists of a trip to one of three host cities (Vancouver, Ottawa or Halifax) to compete in-person in a regional chili cook-off challenge (the "Semi-Finalist Event") with host Anthony Sedlak during the week of January 17, 2011. Each Semi-Finalist Prize includes:
      1. round-trip economy airfare for the Semi-Finalist from a major Canadian airport closest to Finalist's home to the host city in the Semi-Finalist's region (as defined herein); If Semi-Finalist resides within 300 kms of the host city, the airfare portion of the Semi-Finalist Prize shall be forfeited and Semi-Finalist shall be responsible for his/her own return transportation to the host city;
      2. one (1) night standard accommodation for Semi-Finalist (one(1) single room, single occupancy, room and taxes only) at the hotel selected by the Sponsor;
      3. ground transportation for the Semi-Finalist between the airport and hotel in the destination city, and the hotel and the Semi-Finalist Event venue;
      4. a meal allowance as predetermined by Sponsor.
    2. Semi-Finalist Prize Value. Each Semi-Finalist Prize has an approximate value of one thousand dollars (CDN $1,000.00). Actual value of Finalist Prize will depend on departure city and destination, and whether airfare is included.
    3. Semi- Finalist Prize Terms and Conditions. Semi-Finalists are solely responsible for all costs and expenses not expressly described herein as included in the Semi-Finalist Prize, including, without limitation, applicable taxes, fuel/currency surcharges, ground transportation outside that listed above, sightseeing tours, merchandise, telephone calls, room service, alcoholic beverages, insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover. Exact dates and details of travel to be confirmed, and are at the sole discretion of the Sponsor. The Sponsor reserves the right to select the hotel and method of ground transportation. The travel dates chosen are subject to flight and hotel availability. Sponsor reserves the right to select alternate hotel accommodation, if the arranged hotels are unavailable on dates selected. Once travel arrangements have been confirmed, no changes are permitted and in the instance of not being able to travel, no rebooking dates will be granted and full cancellation fees apply, which will be the sole responsibility of the Finalist. All travel arrangements will be booked by Sponsor's designated agency or representative. In the event a Semi-Finalist is unable to redeem the Semi-Finalist Prize as awarded, the Sponsor or any parties associated with this Semi-Finalist Prize will provide neither compensation nor substitutions.
    4. Finalist Prizes. There are four (4) finalist prizes (“Finalist Prizes”, and each, a “Finalist Prize”) to be awarded. Three (3) Finalist Prizes are available to be won by the Contest finalists (“Finalists”, and each, a “Finalist”), and one (1) Finalist Prize will be awarded to the Winner of the last ZANTAC® Chili Challenge 2009/2010. Each Finalist Prize consists of a trip to Toronto, Ontario to compete in-person in the final chili cook-off challenge (the “Final Event”) hosted by Anthony Sedlak during the week of February 2, 2011. Finalist Prize includes:
      1. round-trip economy airfare for the Finalist from a major Canadian airport closest to Finalist's home to Toronto, Ontario; If Finalist resides within 300 kms of Toronto, the airfare portion of the Finalist Prize shall be forfeited and Finalist shall be responsible for his/her own return transportation to Toronto;
      2. one (1) night standard accommodation for Finalist (one(1) single room, single occupancy, room and taxes only);
      3. ground transportation for Finalist between the airport and hotel in Toronto, and the hotel and the Event venue;
      4. a meal allowance as predetermined by Sponsor.
    5. Finalist Prize Value. Each Finalist Prize has an approximate value of two thousand dollars (CDN $2,000.00). Actual value of Finalist Prize will depend on departure city, and whether airfare is included.
    6. Finalist Prize Terms and Conditions. Finalists are solely responsible for all costs and expenses not expressly described herein as included in the Finalist Prize, including, without limitation, applicable taxes, fuel/currency surcharges, ground transportation outside that listed above, sightseeing tours, merchandise, telephone calls, room service, alcoholic beverages, insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover. Exact dates and details of travel to be confirmed, and are at the sole discretion of the Sponsor. The Sponsor reserves the right to select the hotel and method of ground transportation. The travel dates chosen are subject to flight and hotel availability. Sponsor reserves the right to select alternate hotel accommodation, if the arranged hotels are unavailable on dates selected. All travel arrangements will be booked by Sponsor's designated agency or representative. In the event a Finalist is unable to redeem the Finalist Prize as awarded, the Sponsor or any parties associated with this Finalist Prize will provide neither compensation nor substitutions.
    7. Grand Prize. There is one (1) grand prize (“Grand Prize”) available to be won by the Grand Prize winner (“Grand Prize Winner”) consisting of an all-inclusive trip for the Grand Prize Winner and one (1) travelling companion (“Guest”) to the Mayan Riviera, Mexico which shall include:
      1. round-trip economy airfare for the Grand Prize Winner and Guest leaving together from the same gateway from a major Canadian airport closest to Grand Prize Winner's home to Mexico;
      2. seven (7) nights hotel accommodation at a resort to be selected by Sponsor in its sole discretion for the Grand Prize Winner and Guest based on double occupancy; and
      3. daily meals and beverages and features as provided under the selected resort's all-inclusive terms and conditions.
    8. Grand Prize Value. The Grand Prize has an approximate value of three thousand dollars (CDN $3,000.00). Actual value of Grand Prize will depend on departure city.
    9. Grand Prize Terms and Conditions. The Grand Prize travel package must be taken no later than December 31, 2011.  Should Grand Prize Winner and Guest be unable to travel on dates and times designated by the Sponsor, the Prize will be forfeited. Grand Prize Winner and Guest are solely responsible for all costs not expressly described herein as included in the Grand Prize, including, without limitation, applicable taxes, fuel/currency surcharges, ground transportation, sightseeing tours, room service, gratuities, merchandise, telephone calls, insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover. It is the sole responsibility of the Grand Prize Winner and Guest to obtain all necessary travel documentation including passports and visas, as applicable, and to comply with any customs and immigration requirements. It is recommended that Grand Prize Winner and Guest obtain sufficient personal insurance prior to departure.  Sponsor is not responsible in the event that the Grand Prize Winner or the Guest is refused entry to the destination city or re-entry to Canada, for whatever reason, in which event, an unused portion of the prize will be forfeited. All arrangements for the Grand Prize trip must be booked through the Sponsor’s designated agent or representative and the Grand Prize Winner and Guest will be required to travel on the same itinerary. Sponsor does not assume responsibility for cancelled, delayed, suspended or rescheduled events after ticketing of Grand Prize for any reason whatsoever. Planned travel dates chosen are subject to availability. Sponsor reserves the right to select alternate hotel accommodation, if the arranged hotel is unavailable on dates selected. Once travel arrangements have been confirmed, no changes are permitted and in the instance of not being able to travel, no rebooking dates will be granted and full cancellation fees apply, which will be the sole responsibility of the Grand Prize Winner.  In the event the Grand Prize Winner is unable to redeem the Grand Prize as awarded, the Sponsor or any parties associated with this Grand Prize will provide neither compensation nor substitutions.
    10. Grand Prize and Semi-Finalist and Finalist Prizes are hereafter collectively referred to as “Prize” or “Prizes”. Grand Prize Winner and Semi-Finalists and Finalists are hereafter collectively referred to as a “Winner” or “Winners”.
    11. Winner is not entitled to monetary difference between actual Prize value and stated approximate Prize value, if any.
    12. Prizes will be distributed within a reasonable amount of time after each Winner has been successfully contacted and notified of his/her Prize and fulfilled the requirements set out herein.
    13. Guests must comply with the Contest Rules and sign and return the Release (described below).
    14. Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsors. Any unused portion of a Prize will be forfeited and have no cash value. The Sponsors reserve the right, in its and their sole discretion, to substitute a prize of equal or greater value if a Prize (or any portion thereof) cannot be awarded for any reason.
    15. Shipped Prizes shall not be insured and the Sponsors shall not assume any liability for lost, damaged or misdirected Prizes.
  6. WINNER SELECTION.
  7. Nine (9) Semi-Finalists shall be selected as follows:

    1. SEMI-FINALISTS. On or about December 30, 2010 by approximately 5:00 p.m. EST, the top nine (9) Recipes submitted nationally as indicated by consumer votes received during the Voting Period will be tabulated and potential Semi-Finalists selected (in the event of a tie, the entry with the earliest original Recipe submission date will be selected). The entrants for each of the top three (3) Recipes from each region (Western Region – British Columbia & Alberta, Central – Saskatchewan, Manitoba & Ontario, and Eastern – New Brunswick, Nova Scotia, P.E.I. and Newfoundland.) will then be declared potential Semi-Finalists and invited to prepare their chili Recipes live at the Semi-Finalist cook-off Event within their region (collectively “Semi-Finalist Events” and each a “Semi-Finalist Event”) to be hosted by Anthony Sedlak in one of the following three major Canadian host cities (Vancouver for the Western Region, Ottawa for the Central Region, or Halifax for the Eastern Region) during the week of January 17, 2011 to compete for a chance to win a Finalist Prize. To be declared a Semi-Finalist, the selected entrant shall be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered during a pre-arranged telephone call or by e-mail, to comply with the Contest Rules and sign and return the Release (described below). The Sponsor may, in its sole discretion, provide an alternate skill-testing question or vary the requirements to perform any skill-testing component of the Contest to accommodate and include the participation of entrants with physical or cognitive disabilities. Odds of being selected as a Semi-Finalist are dependent on the total number of entries received by close of the Submission and Voting Periods.  Recipes of the Semi-Finalists will be judged by an independent judging panel and Anthony Sedlak, for a chance to win a Finalist Prize. Each chili recipe prepared live will be tasted by the judges, through a taste test and receive a score based on the following criteria in no particular order: taste, visual appeal/presentation, originality and creativity. The Recipe with the highest averaged score assigned by the judges will be deemed the Region’s potential Finalist Prize Winner.
    2. EACH SELECTED POTENTIAL SEMI-FINALIST WILL BE NOTIFIED BY TELEPHONE or E-MAIL WITHIN THREE (3) BUSINESS DAYS OF SELECTION AND MUST RESPOND WITHIN THREE (3) BUSINESS DAYS OF NOTIFICATION. Upon notification, the selected entrant must respond by telephone to the contact number provided in the notification, and the selected entrant's response must be received by the Sponsor within three (3) business days of such notification. If the selected entrant does not respond in accordance with the Contest Rules, he/she will be disqualified and will not receive a Prize and another entrant may be selected in the Sponsor' sole discretion until such time as an entrant satisfies the terms set out herein. The Sponsor are not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Sponsor to receive a selected entrant's response.
    3. If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more selected entrants than contemplated in these Contest Rules, there will be a random draw amongst all eligible Semi-Finalist Prize claimants after the close of the Voting Period to award the correct number of Semi-Finalist Prizes.
    4. Four (4) Finalists shall be selected as follows:

FINALISTS – During the week of February 2, 2010, the Final Event will take place in Toronto, Ontario where the four (4) Finalists will prepare their selected, original chili Recipes in-person for a panel of independent judges and host Anthony Sedlak. Each Recipe will be judged by the independent judging panel including Anthony Sedlak, for a chance to win the Grand Prize. The Finalist Recipes will be judged through a taste test scored on the same criteria previously defined herein. The Recipe with the highest averaged score assigned by the judges will be deemed the potential Grand Prize Winner. To be declared the official Grand Prize Winner, the selected Finalist must comply with the Contest Rules and sign and return the Release (described below) within the specified time period . Odds of being selected as the Grand Prize Winner are 1:4.
    6. The judges, in their absolute discretion, shall select the Finalist Winners based upon the following scores derived from the taste test based on the criteria as defined above. The decisions of the judges shall be final and binding and may not be challenged in any way.
    7. EACH SELECTED POTENTIAL FINALIST WILL BE NOTIFIED IN PERSON AT THE CONCLUSION OF THEIR RESPECTIVE SEMI-FINALIST EVENT AND MUST RESPOND IMMEDIATELY UPON NOTIFICATION. Upon notification, the selected entrant must respond by complying with the terms of this agreement. If the selected entrant does not respond in accordance with the Contest Rules, he/she will be disqualified and will not receive a Prize and another entrant may be selected in the Sponsor’ sole discretion until such time as an entrant satisfies the terms set out herein. The Sponsor are not responsible for the failure for any reason whatsoever of a selected entrant to receive or accept notification or for the Sponsor to receive a selected entrant’s response.
    8. If, as a result of an error relating to the entry process, judging, drawing or any other aspect of the Contest, there are more selected entrants than contemplated in these Contest Rules, there will be a random draw amongst all eligible Finalist-Prize claimants after the close of all three Semi-Finalist Events to award the correct number of Finalist Prizes.
    9. One (1) Grand Prize Winner shall be selected as follows:

During the week of February 2, 2010, the Final Event will take place in Toronto, Ontario where the four (4) Finalists will prepare their selected, original chili Recipes in-person for a panel of independent judges and host Anthony Sedlak.     11. The judges, in their absolute discretion, shall select the Grand Prize Winner based upon the scores derived during the blind taste test. The decisions of the judges shall be final and binding and may not be challenged in any way.
    12. THE SELECTED ENTRANT WILL BE NOTIFIED ONSITE AT THE CONCLUSION OF THE FINAL EVENT AND MUST RESPOND IMMEDIATELY UPON NOTIFICATION. If the selected entrant does not respond in accordance with the Contest Rules, he/she will be disqualified and will not receive a Prize and another entrant may be selected in the Sponsor’ sole discretion until such time as an entrant satisfies the terms set out herein. The Sponsor are not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response
    13. If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more selected entrants than contemplated in these Contest Rules, there will be a random draw amongst all eligible Prize claimants after the Contest's closing date to award the correct number of Prizes.
  8. RELEASE. Winners will be required to execute a legal agreement and release ("Release") that confirms Winners': (i) eligibility for the Contest and compliance with these Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of each of the Sponsor and its respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, Sponsor, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the "Releasees") from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iv) grant to the Sponsor of the unrestricted right, in the Sponsor's collective or individual discretion, to produce, reproduce, publish, reproduce, convert, broadcast, communicate by telecommunication, exhibit, distribute, translate, adapt and otherwise use and re-use the Work and Winner's name, photograph, likeness, voice and biography in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The executed Release must be returned within two (2) business days of the verification as a Winner or the selected entrant will be disqualified and the Prize forfeited.
    The traveling companion of the Grand Prize Winner (“Guest”) will be required to execute a legal agreement and release (“Release”) in order to participate in the Prize, that confirms Guest’s: (i) eligibility and compliance with these Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of each of the Sponsor and its respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, Sponsor, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iv) grant to the Sponsor of the unrestricted right, in the Sponsor’s collective or individual discretion, to produce, reproduce, publish, reproduce, convert, broadcast, communicate by telecommunication, exhibit, distribute, translate, adapt and otherwise use and re-use the Work and Guest’s name, photograph, likeness, voice and biography in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The executed Release must be returned within two (2) business days of the verification of the Winner or the Guest portion of the Prize will be forfeited.
  9. INDEMNIFICATION BY ENTRANT. By entering the Contest, entrant releases and holds Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, any breach of the Contest Rules, or in any Prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the Contest, without limitation.
  10. RIGHTS CLEARANCE. By providing the Work to the Sponsor in connection with the Contest, each entrant shall retain all right, title and interest (including copyright) in and to the Work, and shall grant to the Sponsor a worldwide, gratuitous, irrevocable, and exclusive licence to copy, use, modify, reproduce, display, adapt and transmit the Work for use in all media now known or hereafter devised in perpetuity beginning on the date of entry, including, but not limited to, in connection with the administration, promotion and exploitation of the Contest. The entrant hereby confirms that the Work is an original work, solely created by the entrant, and that no third party participated as an author, co-author, photographer or otherwise in the creation of the Work or any part thereof. Sponsor assumes no responsibility for any claims of infringement of rights to copyright, privacy and/or personality, and all such liability shall remain with the entrant. In addition, each entrant represents to the Sponsor that the Work does not infringe any copyright interest of any third party and that the Work is not defamatory or obscene and does not violate any laws relating to hate speech or otherwise. Sponsor reserves the right to exclude any Work on the basis of concerns relating to the rights of third parties, including but not limited to privacy, copyright, defamation, rights of personality, obscenity or hate speech, as determined by Sponsor in their sole discretion.
  11. LIMITATION OF LIABILITY. The Sponsor assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Sponsor is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. The Sponsor assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest or the Contest Website.
  12. CONDUCT. By participating in the Contest, each entrant agrees to be bound by the Contest Rules, which will be posted at the Contest Website throughout the Contest Period. Entrant further agrees to be bound by the decisions of the judges and Sponsor, which shall be final and binding in all respects. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest or the Contest Website; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any online Johnson & Johnson Inc. property or service; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. Winner must at all times behave appropriately when taking part in the Semi-Final and Final Event(s) and observe the Contest Rules and any other rules or regulations in force at the studios and/or Event venues. The Sponsor reserves the right to remove from the Event venue(s) or prize destination(s), any Winner or Guest as applicable who breaks such rules and/or fails to behave appropriately and to disqualify such Winner.
  13. PRIVACY / USE OF PERSONAL INFORMATION.
    1. By participating in the Contest, entrant: (i) grants to the Sponsor the right to use his/her name, mailing address, telephone number, and e-mail address ("Personal Information") for the purpose of administering the Contest, including but not limited to contacting and announcing the Winners and inviting Winners to return to compete in future Contests; (ii) grants to the Sponsor the right to use his/her Personal Information for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of any of the Sponsor in connection with any of the activities listed in (i) and (ii) above.
    2. The Sponsor will use the entrant's Personal Information only for identified purposes, and protect the entrant's Personal Information in a manner that is consistent with the McNeil Consumer Healthcare, division of Johnson & Johnson Inc. Privacy Policy at: www.chilichallenge.ca.
  14. INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. ZANTAC® is a trade-mark of Johnson & Johnson, used under licence.
  15. TERMINATION. Sponsor reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest Rules in any way, at any time, for any reason without prior notice.
  16. LAW. These are the official Contest Rules. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws.
  17. LANGUAGE DISCREPANCY. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
